Terms of Service

Welcome to SpiralBig. By accessing, purchasing, downloading, or using the domain intelligence datasets, newly registered domain feeds, historical WHOIS archives, WHOIS lookup APIs, or web services provided by SpiralBig ("Service"), you signify that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms" or "Agreement").

1. Definitions

"Customer" or "User": Any individual, corporation, cybersecurity analyst, researcher, or entity subscribing to or accessing the Service.
"Data Feeds": All downloadable raw CSV, JSON, and parsed database archives containing newly registered domains, historical WHOIS records, or dropped domains.
"API": SpiralBig's Application Programming Interface endpoints designed for programmatic querying of domain metadata and real-time records.
"Subscription": A recurring or one-time paid commercial access tier entitling the Customer to download daily database updates or query APIs.

2. License Grant & Permitted Use

Subject to your ongoing compliance with these Terms and timely payment of applicable subscription fees, SpiralBig grants you a non-exclusive, non-transferable, worldwide commercial license to access, ingest, index, and analyze our Data Feeds for the following permitted purposes:

Permitted Commercial Operations

Cyber threat hunting & malware staging detection
Security Information and Event Management (SIEM) enrichment
Brand protection, trademark monitoring & anti-typosquatting
B2B sales prospecting & technology adoption analysis
Domain investment portfolio appraisal & aftermarket trading
Academic, legal dispute (UDRP), and forensic research

Explicitly Prohibited Operations

Sending unsolicited commercial spam in violation of CAN-SPAM or CASL
Deploying automated cyber attacks, phishing, or botnets
Reselling, sublicensing, or distributing raw database dumps as a competing standalone feed
Bypassing or manipulating API rate-limiting thresholds
Scraping or harvesting SpiralBig proprietary web assets

3. Account Security & API Keys

Customers are responsible for maintaining the confidentiality of their login credentials and API tokens. You agree to notify SpiralBig immediately at security@spiralbig.com upon detecting any unauthorized access or compromise of your account. You accept full liability for all activities conducted under your credentials prior to reported notification.

4. Billing, Auto-Renewal & Payment Terms

Subscriptions are billed in advance on a recurring monthly or annual cycle depending on your selected tier. Payments are processed securely in Indian Rupees (INR) via Razorpay or in US Dollars (USD) via PayPal. Unless cancelled prior to the conclusion of your active billing cycle through your account settings, your subscription will automatically renew at the prevailing list price.

5. Service Availability & Service Level Objective (SLO)

SpiralBig strives to maintain a 99.9% uptime for its API endpoints and to publish daily newly registered domain files by 08:00 UTC each calendar day. Occasional scheduled maintenance will occur during low-traffic windows with prior notice. SpiralBig shall not be held liable for delays caused by upstream registry interruptions, ICANN root server outages, or Tier-1 transit disruptions outside our direct infrastructure.

6. Intellectual Property Rights

All proprietary software code, parsing heuristics, data normalization schemas, website layout designs, logos, trademarks, and documentation published on SpiralBig are the exclusive intellectual property of SpiralBig and protected under international copyright treaties. Raw public registry records remain under public record standards; however, our unique normalized dataset formatting, categorization algorithms, and compilations constitute protected database copyrights.

7. Disclaimer of Warranties

THE SERVICE AND ALL DATASETS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPIRALBIG DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SPIRALBIG DOES NOT WARRANT THAT THE REGISTRY DATA REPORTED BY THIRD-PARTY REGISTRARS IS 100% ACCURATE OR VERIFIED AT SOURCE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPIRALBIG, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA CORRUPTION, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE TOTAL FEES PAID BY YOU TO SPIRALBIG IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of India, without giving effect to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.
